Fair Use Doctrine and William Quick

I just received a vituperative phone call from William Quick. He used several obscenities to yell at me because I used a picture from his website, a picture of my sister Stephanie,  to illustrate a story about his wife’s actions to destroy my father’s heritage from Buchenwald. He threatened, as he has before, to use  lawyers to go after me under copyright law.

I also value my privacy but would remind Bill of three things.

First, his own behavior. He not only attempted to have my employer send me to a mental hospital because of this blog, Bill used the Public Records Law in my state to demand all of my emails.  In effect this meant making public numerous private discussions with colleagues and student about matters that they (and I) would normally have reason to assume were confidential.  Certainly the PRR laws were not meant to prevent University faculty from having discussions with students or colleagues about academic issues or personal matters of no relevance to any normal citizen much less whatever salacious intent Bill imagines.

Second, Bill or someone whose IP is remarkably close to Bill’s address in North Charleston South Carolina, has posted to this website claiming to be Roberta Flack, one of my favorite singers.  I have asked Ms. Flack’s agents  about this and they deny the association with Dr. Quick.  If this was Bill, he might consider whether this was a violation of her privacy?

Third, Bill needs to read the meaning of “copyright” and fair use law.      My understanding of the law is that anything published, that is provided in a public form, is fair use as long as that use is not commercial and is based on the intent to comment on a relevant matter.  If Bill disagrees, he is welcome to file a law suit.  For the record, the portrait in the upper right corner of this post was also taken from a picture posted on Bill’s website.
