Two Views:
ROGER RABBIT: The world just changed. Justice Antonin Scalia has died. I wonder if Republicans will claim the Clintons murdered him? I haven’t checked Drudge yet.
President Obama now has the opportunity to switch the Supreme Court majority from conservative to liberal if he can get an appointee through the GOP-controlled Senate. I nominate Elizabeth Warren.
SMS:
The threat by the GOP to block any appointment is going to be a great lubricant for the campaign to elect Hillary or Bernie as President.
Warren is not Obama’s style and would give the GOP too much of an argument to delay confirmation.
I expect him to choose someone who will confront the Repugnant’s, during a Presidential Race, of being openly racist. The other rules? 1. .. not female as he has appointed to women already and a court where the left is female and the right male would not be good. 2. intellectually impressive. 3. well regarded by corporate, liberal America (as opposed to the all to wealthy radical right).
Making things worse for the GOP, there will be about two weeks between the end of the Congress in 2017 and the inauguration of a new President. The Constitution gives the Chief Executive the opportunity to fill a vacancy on the Court temporarily, bypassing the Senate initially, if a nominee languishes in the Senate without final action.

Article II Section 2 of the Constitution says the President of the United States nominates justices to the Supreme Court, with the advice and consent of theSenate. I can’t find a clause that says “…except when there’s a year left in the term of a Democratic President.”
Senate Republicans took an oath just like Senate Democrats did. Abandoning the duties they swore to uphold would threaten both the Constitution and our democracy itself. It would also prove that all the Republican talk about loving the Constitution is just that — empty talk.
Bottom line: President Obama could nominate a new Justice of his choosing, to serve temporarily. The resulting Constitutional crisis would …of course .. have to be settled by the Supreme Court.
My guesses:
Duval Patrick
The 71st Governor of Massachusetts was the first (and, currently, the only) African-American to have served as Governor of Massachusetts.
Like Michelle Obama, Duval Patrick was raised on the South Side of Chicago, in his case by a single mother. Again, like Michelle and like Sonia Sotomayor, Patrick benefited hugely form efforts at Affirmative Action. He attended the elite Milton Academy in Massachusetts, followed by Harvard College, andHarvard Law School. Worked in civil rights law at the NAACP Legal Defense and Educational Fund and then, under President Bill Clinton.
His career is also a corporate career. Patrick held lead positions as a lawyer and as a businessman at Texaco and Coca-Cola. After that he served as a director of ACC Capital Holdings, where he helped the company deal with investigations associated with issues of the company’s culture and role in subprime mortgages.
As Governor, Patrick implemented Mitt Romney’s health care program , the predecessor of Obamacare.
Kamala Harris.
Harris is fifty-one, has an outstanding career as a lawyer in government employ and as the California Attorney General. Harris attended Howard University in Washington, D.C.,[20] where she was initiated into Alpha Kappa Alpha sorority, and received her Juris Doctor (J.D.) from University of California, Hastings College of the Law in 1989.[21] She was admitted to the California bar in 1990. The lacki iof a JF from an Ivy may make her unique .. imagine a Justice without a degree form Harvard, Stanford or Yale!
Ms. Harris ethnic story id boith American and confusing to thse who impute race all too easily. She is the daughter of an Indian mother, Dr. Shyamala Gopalan Harris—a breast cancer specialist who emigrated from Chennai, India, to the United States in 1960 and a Jamaican American father, Stanford University economics professor Donald Harris. Kamala’s parents divorced when she was young.
I think she unlikely since she is the prohibitive favorite to win Barbara Boxer’s Senate seat in the 2016 election.
.Cory Booker.
Attended Stanford University, played college football and received a Bachelor of Arts in political science. He earned a Rhodes Scholarship and then a Juris Doctor from Yale Law School. He is terribly bright, a successful mayor and senator.
Corporations were highly supportive of Booker’s efforts as Mayor of Newark. He made reducing crime and encouraging economic development projects personal, involvement his own public service. Millions of dollars were invested in downtown development. Sadly, persistent underemployment and high murder rates continue to characterize Newark.
As a plus in a fight with the GOP, Salon called Booker an avatar of the wealthy elite, a camera hog, and a political cipher.
The other issue is that, unlike the others in this list, Cory Booker has never served as a legal scholar.
His only other negatives may he rumors that he is a closeted gay. He once told the Washington Post : “…People who think I’m gay, some part of me thinks it’s wonderful. Because I want to challenge people on their homophobia. I love seeing on Twitter when someone says I’m gay, and I say, ‘So what does it matter if I am? So be it. I hope you are not voting for me because you are making the presumption that I’m straight.’ ”
Julian Castro
Castro’s has great credentials as a minority advantaged by opportunities in our system.
As a kid in San Antonio, he played football, basketball and tennis; he also collected trading cards. He also skipped his sophomore year of high school and graduated ninth in his class. After turning down an athletic scholarship at another college, Castro chose Stanford University. At this great school, Castro and his twin brother Joaquín won student senate seats, tying for the highest number of votes.[3]
Castro has credited affirmative action for his admission into Stanford, telling The New York Times, “and I got into Stanford because of affirmative action. I scored 1,210 on my SATs, which was lower than the median matriculating student. But I did fine in college and in law school. So did Joaquín. I’m a strong supporter of affirmative action because I’ve seen it work in my own life.”
Castro received his JD from the Harvard Law School. After practicing law, Mr. Castro went on to be a popular mayor of San Antonio and then as Secretary in Obama’s cabinet.
Julian Castro is widely expected to be Hillary (and presumably Bernie’s) choice as Veep. However, the political advantage of having a Hispanic proposed as a Supreme Curt Justice should be more important than the Vice Presidency.
Sri Srinivasan
The 48-year-old moderate D.C. Circuit Court of Appeals judge, has already been labeled Obama’s “Supreme Court nominee in waiting,” by The New Yorker’s Jeffrey Toobin. Srinivasan is poised to be chosen for the Supreme on the D.C. Circuit Court, the second-highest court where John Roberts, Antonin Scalia, Clarence Thomas, and Ruth Bader Ginsburg all were nominated from.
He would be the first Indian-American justice on the highest court. He is ideal because he is conservative on some issues. He is weak because he would not be seen as politically supportive of the Black and Hispanic community.
Paul Watford
Watford, a 48-year-old African-American Ninth Circuit Court of Appeals Judge who Obama said “has displayed exceptional dedication to the legal profession throughout his work,” after his 2012 confirmation.
David Barron
First Circuit Court of Appeals Judge David Barron would be a controversial choice for Obama. Barron notoriously authored a secret memo which justified Obama’s decision to order drone strikes on Anwar al-Awlaki, an American citizen who became a radicalized Islamic militant living in Yemen.
He would hurt the Dem base and would not appeal to Black and Hispanic voters.
Merrick Garland
Garland is the Chief Judge of the United States Court of Appeals for the D.C. Circuit, and is known for having lead prosecutions in the Oklahoma City bombing and “Unabomber” Ted Kaczynski cases while he was the Associate Deputy Attorney General from 1994 to 2013. Too “white.”
Patricia Ann Millett
D.C. Circuit judge Patricia Ann Millett, another Harvard Law School alum, has spent most of her career practicing corporate law at the firm Miller & Chevalier She has argued 32 cases before the U.S. Supreme Court and holds a second degree black belt in Tae Kwon Do, according to her profile on the U.S. Court of Appeal site.
But she is from an old Maine family with roots stretching to the Revolutionary War.
Will this put to rest the conservative “intellectual” renaissance of the Supreme Court, which consists of ignoring established legal precedent, contradicting his own prior rulings to further the GOP ideology?
