Did a prosecutor improperly instruct Ferguson grand jury?

While most of the media focus in the Ferguson case has been on Prosecutor Bob McCulloch, crucial parts of the prosecution case were presented to the grand jury by an assistant prosecutor named Kathi Alizedah, who told grand jurors just prior to Officer Darren Wilson’s testimony to ignore what his department’s policies were and “instructed grand jurors on how to decide the case based on a statute that was invalidated by the U.S. Supreme Court two decades ago.” The statute in question, which said “officers can use any force they deem necessary to achieve the arrest of a fleeing suspect” was held unconstitutional in 1985.

Although Alizedah may have attempted to correct the mistake, it appears she did so in a manner intended to confuse the grand jury.

Several Missouri law professors are crying foul on McCulloch’s partiality toward Wilson, and confirmed that a St. Louis presiding judge can independently appoint a special prosecutor for further consideration of bringing charges against Wilson if she wants to.
