“Lawyers for supporters of the Texas abortion law told a federal appeals court Thursday that the state was free to pass its law banning abortion after about six weeks because states can reach their own conclusions about whether abortion [is] constitutional,” NBC News reported on Thursday, October 14, 2021.

“The lawyers for intervenors in the case supporting Texas said that while states are bound by the text of the Constitution, they need not follow Supreme Court rulings about constitutional rights,” NBC News said.

Yeah, they said that about slavery, too. Lincoln didn’t buy it. Neither did General Grant or the Army of the Potomac. The Supreme Court may overturn Roe v. Wade, but probably not on those grounds, because that would make all of the court’s rulings advisory, and the court doesn’t issue advisory rulings, so the justices would be out of work.
