When Trump Bans the Real Media

A case just decided in New York underscores that barring media from briefings, based on “viewpoint discrimination,” is likely unconstitutional. This obviously bears on Trump’s press secretary’s recent action barring certain media from a briefing. An expert explains: “If you exclude reporters from briefings that they otherwise have a right to attend because you don’t like their reporting, then you have engaged in viewpoint discrimination.” Viewpoint discrimination by the government in a public forum is almost always unconstitutional.”
